Terms of Use

These Terms of Use (“Terms”) apply to your access and use of the Agency OS Portal Kit, all related materials, and the Elevate Labs AI website. By accessing, purchasing, or using the Product, you agree to these Terms.

“Provider” means Clear & Young Ltd trading as Elevate Labs AI.
“Product” means the Agency OS Portal Kit including templates, guides, and documentation.
“Client”, “you” means the person or business accessing or purchasing the Product.

1. Acceptable Use

You agree not to use the Product or the Site to:

• Copy, duplicate, or redistribute the Product or documentation except as permitted under your licence;
• Share internal documentation publicly or with third parties outside your organisation;
• Reverse-engineer, decompile, or attempt to recreate the Product for the purpose of selling a competing template or system;
• Use the Product in breach of any applicable law.

2. Licence Terms

Provider grants you a non-exclusive, non-transferable licence to:

• Use the Product within your own business; and
• Deliver services and build portals for your own clients using the Product.

You may not:

• Resell, redistribute, sublicense or publish the Product itself as a standalone item;
• Sell or distribute any part of the templates, documentation, portal structure or SOP as a commercial product without written permission from Provider.

Clarification: You are free to charge your own clients for access to the portals you create with the Product. What you cannot do is resell or distribute the underlying Product, SOP, templates, or documentation as your own product.

3. Data & privacy

All data stored inside Airtable, Softr, or other tools you connect is stored in your own accounts. Provider does not store or process your client/customer data unless you explicitly grant temporary access during onboarding.

Your use of the Site is also governed by our Privacy Notice.

4. Third-party platforms

The Product relies on third-party platforms such as Airtable, Softr, Stripe, Make/Zapier and others. Your use of those services is subject to their terms and policies. Provider is not responsible for outages, feature changes, pricing changes, data loss or limitations caused by those platforms.

5. No promise of financial results

Any examples of pricing, revenue, or ROI shared in demos, marketing or documentation are illustrative only and do not guarantee any particular income or outcomes for your agency. Your results depend on your own pricing, sales process, client base and implementation.

6. Ownership & intellectual property

All intellectual property rights in the Product, including templates, structures, workflows, layouts, documentation and SOPs, remain the exclusive property of Provider. No transfer of ownership is granted.

Your licence is limited to use within your business for delivering services to your own clients.

You must not remove, obscure, modify or alter any proprietary notices contained in the Product.

7. Limitation of liability

To the fullest extent permitted by law:

• Provider is not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, contracts, data or goodwill.
• Provider’s total aggregate liability relating to the Product or Site is limited to the amount you paid for the Product in the 6 months before the claim, or £500, whichever is lower.
• Nothing in these Terms limits liability for fraud or for any matter that cannot be excluded under law.

Provider does not act as data controller for your customers’ information stored in Airtable, Softr or other third-party tools. You remain responsible for data entered into your accounts.

8. Disclaimer of warranties

The Product is provided “as is” without any warranties of any kind, express or implied. Without limiting the foregoing:

• Provider does not warrant that the Product will be error-free, uninterrupted, or compatible with future versions of Softr, Airtable or other tools;
• Provider does not guarantee any particular business, operational or financial outcome arising from use of the Product;
• The suitability of the Product for your specific business purposes is your responsibility.

9. Changes to these Terms

Provider may update these Terms from time to time to reflect changes in the Product, applicable laws or business operations. Material changes will be posted on this page. Continued use of the Product after such changes are posted constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of England and Wales. Any dispute shall be brought exclusively before the courts of England and Wales.
